Campaign in Court

The Haemophilia Society itself in not involved in any legal action at the moment.

However, we are aware of many members who are involved in legal actions in relation to the contaminated blood campaign.

The campaign recently saw a historic legal victory in Scotland where a Judicial Review ruled that, under article 2 of the European Convention on Human Rights, the UK had a duty to hold an inquiry when someone dies as a result of actions of the state. This was demonstrated not to have happend in at least two cases in Scotland and as a direct result of this ruling the Penrose Inquiry was set up. The Haemophilia Society unwrote some of the legal costs for this judicial review and many members in Scotland contributed generously to a fighting fund.

In March 2010 there was a historic defeat for the Government at Judicial Review. Details of the judgement can be found by following the link below. The Coalition Government has announced that it will not be appealing the decision.
